Terms of Service

These Terms of Service ("Terms") govern your use of the Signals & Sorcery desktop application and website (together, "the Service"), operated by Steve Hiehn ("we", "us"). By using the Service, you agree to these Terms.

We've tried to keep this short, honest, and in plain English. If anything here is unclear, email stevehiehn@gmail.com and we'll explain.

Our Promise To You

We run Signals & Sorcery as a dead-simple subscription service that always operates in your favor:

  • Cancel any time, no questions asked. No retention phone calls, no dark patterns, no "are you sure?" guilt trips.
  • No hidden fees. The price you see is the price you pay.
  • Your music is yours. You own whatever you create with the app.
  • No lock-in. You can export your work and walk away whenever you want.

1. The Service

Signals & Sorcery is a macOS desktop application for generative music composition and performance. It uses AI models (Gemini for MIDI and Lyria for audio) hosted by Google Cloud to generate musical content within user-defined constraints.

2. Your Account

  • You must provide accurate information when you create an account.
  • You are responsible for keeping your account credentials secure.
  • You must be at least 13 years old (or the minimum age of digital consent in your country) to create an account.

3. Subscription & Billing

How It Works

  • The Service is offered on a recurring subscription basis billed through Stripe.
  • Your subscription automatically renews at the end of each billing period unless you cancel.
  • The current price and billing frequency are shown at checkout before you subscribe.

Cancellation

  • You can cancel at any time, directly from the app or by emailing stevehiehn@gmail.com.
  • When you cancel, your subscription remains active until the end of the current billing period — we do not cut off access early.
  • No questions asked. We won't email you guilt trips or try to talk you out of it.

Refunds

  • If the Service is not working as advertised, or if you were billed in error, contact us and we will make it right.
  • If you forgot to cancel and were billed for a period you didn't intend to use, email us within 30 days and we will refund it, no questions asked.
  • We value fairness over squeezing every last dollar. If something feels wrong, reach out — we'll do the right thing.

Price Changes

  • If we ever change the subscription price, we will notify you by email at least 30 days in advance.
  • Price changes only apply to future billing periods. You can cancel before the new price takes effect if you disagree.

Taxes

  • You are responsible for any applicable taxes, which may be added to your subscription by Stripe based on your location.

4. Acceptable Use

You agree not to:

  • Use the Service for anything illegal.
  • Try to reverse engineer, break, or attack the Service or its infrastructure.
  • Use the AI generation features to produce content that infringes someone else's copyright, is defamatory, harmful, or violates any applicable law.
  • Share your account credentials with others or resell access to the Service.

We reserve the right to suspend accounts that are clearly abusing the Service or attempting to harm other users, but we will always try to contact you first and give you a chance to resolve the issue.

5. Your Content & Ownership

  • You own your music. Any MIDI, audio, or project files you create with the Service belong to you. We claim no rights over your creative output.
  • You are responsible for making sure your use of AI-generated content complies with the terms of the underlying AI providers (Google Cloud for Gemini and Lyria).
  • You grant us a limited technical license to process your inputs (musical contracts, prompts) only to the extent necessary to deliver the Service to you.

6. Third-Party Services

The Service relies on third-party providers, including:

Your use of the Service is also subject to these third parties' terms where they apply.

7. Availability & Changes

  • We make a good-faith effort to keep the Service running, but we cannot guarantee 100% uptime. Maintenance, outages at Google Cloud, or issues with other providers may occasionally interrupt service.
  • We may add, change, or remove features over time to improve the Service.
  • If a material change would significantly reduce the value of the Service for you, you are welcome to cancel and request a prorated refund for the unused portion of your current billing period.

8. Disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

AI-generated content is produced by third-party models (Gemini and Lyria) and may be unpredictable. We do not guarantee that generated content will be novel, original, or free from similarity to existing works.

9. Limitation of Liability

To the maximum extent permitted by law, our total liability to you for any claim arising out of or relating to the Service is limited to the amount you paid us in the 12 months before the claim arose. We are not liable for indirect, incidental, consequential, or punitive damages.

Nothing in these Terms limits liability that cannot be limited under applicable law (for example, liability for gross negligence or willful misconduct).

10. Termination

  • You can stop using the Service and cancel your subscription at any time.
  • We may suspend or terminate accounts that violate these Terms or the Acceptable Use section above.
  • If we terminate your account for a reason other than misconduct, we will refund any unused portion of your current billing period.

11. Governing Law

These Terms are governed by the laws of the United States and the state in which Steve Hiehn resides, without regard to conflict of laws principles. Any disputes will be resolved in the courts of that jurisdiction, unless applicable consumer protection law in your country grants you the right to bring claims locally.

12. Changes to These Terms

If we make material changes to these Terms, we will update the "Last updated" date above and notify you by email or in the app at least 30 days before the changes take effect. Continued use of the Service after the effective date means you accept the updated Terms. If you don't agree, you can cancel your subscription before the changes take effect.
